India set to decide on surrogate baby’s travel

September 27, 2008

This post is for my readers who are interested to know the status of surrogate baby. I found following update about surrogate baby at The Yomiuri Shimbun.

The Indian Supreme Court on Monday ordered the Indian government to decide within a month whether to issue a passport or a travel certificate to a baby born to an Indian surrogate mother using a Japanese man’s sperm, according to the Indian news agency Press Trust of India.

The Japanese government intends to issue an entry visa to the girl if she obtains the passport or travel certificate.

At the court on Monday, a proxy of the Indian government said the government could issue a passport if the baby’s Indian citizenship was confirmed, and that it could issue a travel certificate if her citizenship was not confirmed.

The father of the child went to India in November to sign a contract with the surrogate mother. The egg for the in vitro fertilization was provided by another Indian woman.

I am reading my blogs and also comments on my blog. I find one comment from one of my reader who asks me what is the status of that Surrogate baby who belong to japans parents. I try to find out the status of that baby and found that The Japanese government has indicated they will allow her entry if requested. The news I found on web is below.

A baby stuck in India in legal limbo after being born to an Indian surrogate mother for a now-divorced Japanese couple will be allowed to leave for Japan.

The Indian government said Monday it will issue a special travel document for the baby, who is stateless and not eligible for a passport.

The Japanese government has indicated it will allow her entry if requested.

The child was born July 25. A Japanese man in his 40s arranged the birth using an egg from an anonymous donor via a fertility clinic in western India. Legal problems arose when the man got divorced before the baby’s birth.

The biological father intends to raise the girl in Japan, according to sources.(IHT/Asahi: September 17,2008)
